Waiver
RELEASE OF LIABILITY
By registering for or participating in Down For Dance programming, events, or other activities, I recognize and agree to the following, on behalf of the volunteer (“Volunteer”). I attest that I agree and have the authority to agree to the terms below on behalf of Volunteer.
1. I recognize that adaptive dance classes and related activities (including but not limited to in-studio classes, online or virtual classes, performances, camp, and other activities), including Down For Dance, require physical exertion that may be strenuous and may cause physical injury to Volunteer and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding Volunteer's participation in any fitness program. I represent and warrant that Volunteer is physically fit and has no medical condition that would prevent full participation in Down For Dance activities.
3. In consideration of Volunteer being permitted to participate in Down For Dance classes and/or camp, I agree to assume full responsibility for any risks, injuries, or damages (known or unknown) or loss of any kind in which Volunteer may incur.
4. In further consideration of being permitted to participate in Down For Dance classes and/or camp, I knowingly, voluntarily and expressly waive any claim that Volunteer may have against Down For Dance, its employees, volunteers, directors, officers, and agents for any injuries or damages (known or unknown) that Volunteer may sustain as a result of participating in any Down For Dance class and/or camp at any studio or performance location.
5. This is a legally binding release, waiver, discharge and covenant not to sue (collectively "release") Down For Dance or any instructor for any injury, death, or loss of any kind caused by Volunteer's voluntary participation in any Down For Dance class or performance. This release, waiver, discharge, and covenant not to sue is made voluntarily by the undersigned releaser, on behalf of the releaser, on behalf of Volunteer, and on behalf of any heirs, executors, administrators, and legal representatives.
6. I certify that I am the Volunteer or parent or legal guardian for Volunteer and have the legal right to waive these rights.
7. I have read the above release, waiver of liability and assumption of risk, fully understand its contents and understand that I am giving up substantial rights, including my right to sue.
I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be the complete and unconditional release of all liability. I voluntarily agree to the terms and conditions stated above. This agreement remains in effect for as long as I participate in any Down For Dance class or other Down For Dance activities.
PHOTO / VIDEO RELEASE
I grant to Down For Dance, it’s representatives and employees the right to take photographs and video of Volunteer in connection with the above-identified company. I authorize Down For Dance, it’s assignees and transferees to copyright, use and publish the same in print and/or electronically. I agree that Down For Dance may use such photographs and video of Volunteer with or without Volunteer's name and for any lawful purpose, including for example such purposes as publicity, advertising, illustrations and web content.
IN-PERSON HEALTH POLICY
For in-person classes, I agree to abide by DFD's healthy policy including, but not limited to the following:
If You Are Sick or Have Been Exposed:
- Do not attend class if you are exhibiting any symptoms of illness, including but not limited to fever, cough, shortness of breath, sore throat, loss of taste or smell or fatigue.
- If you have tested positive for COVID-19 or any other contagious illness, please remain home until you have met the following criteria: You are fever-free for 24 hours without the use of fever-reducing medications & any other symptoms have improved.
- Please notify DFD immediately if you have attended an in-person class & subsequently tested positive for COVID-19 or other contagious illnesses. This helps us take appropriate precautions with other participants.
Personal Protection:
- Masks are optional but highly encouraged. While we understand that the decision to wear a mask is a personal one, we strongly recommend it, especially given the close proximity in which participants work & the physical exertion involved in classes.
- Masks may be required for anyone returning to class after isolation or quarantine, as a precautionary measure for the safety of all participants.
- Water bottles must be clearly labeled with the participant's name to avoid confusion & reduce the risk of cross-contamination.

BEHAVIOR POLICIES
Anti-Harassment & Anti-Discrimination Policy
- We are committed to an environment of mutual respect—harassment, bullying, intimidation, discriminatory language/behavior & sexual harassment are not tolerated.
- If a student, volunteer, staff member or contractor experiences or witnesses harassment, it must be reported to a DFD Director as soon as possible.

Sexual Misconduct Policy
- DFD strictly prohibits sexual abuse or misconduct in any form.
- Any suspected sexual abuse or misconduct must be reported immediately to a DFD Director.
- Reports are taken seriously and investigated promptly; DFD may involve outside parties (including law enforcement) as required.

Behavior & Interaction Policy
- Volunteers are expected to treat others with kindness & respect, follow instructor/staff directions & maintain appropriate physical/verbal boundaries.
- “Zero tolerance” behaviors result in immediate removal from the program.
- Anyone who experiences or witnesses harassment or concerning behavior is required to report it as soon as possible to a DFD Director. DFD will promptly investigate & address reports.
